KUALA LUMPUR (June 21, 2010):
Commissioners of Oaths will soon be made liable for Statutory
Declarations prepared by deponents to ensure that they are aware of the
contents of the declaration before attesting the document.
The move is to prevent statutory declarations from being easily used by scammers to cheat in land transactions.
Deputy Minister in the Prime Minister's Department
Datuk V K Liew said the Law Reform Committee headed by him is looking
into amending the Statutory Declaration Act 1960 to make it mandatory
for Commissioners of Oath (CO) to read the content of the Statutory
Declaration and only attest their signatures after being satisfied the
content is not contentious and have no element of perjury.
"Under the current Statutory Declaration Act, the CO
is only required to attest their signature to affirm that the person had
signed in front of him.
